Eviction Moratorium News

In March, the Western District Court of Tennessee ruled in favor of landlords who had filed suit against the Centers for Disease Control and Prevention (CDC) that they do not have the statutory authority to place moratoria on evictions and such moratoria are beyond the powers granted to the CDC. The U.S. Department of Justice has appealed this ruling and requested an emergency hearing to issue a stay so that the ruling would not go into effect until an appeal is heard. Earlier this week, the CDC announced that it is extending its nationwide eviction moratorium through June 30, 2021, as it was set to expire at the end of March. The above-mentioned ruling and other similar cases across the country could force changes in the coming weeks to this newly, extended CDC order. 

National Association of REALTORS®  is part of a housing provider coalition that has been advocating for an end to the eviction moratorium and also to provide enough federal assistance to make the housing providers whole, many of whom are struggling to pay their mortgages due to lost rent over the past 12 months. We've stressed since last April that an eviction moratorium merely temporarily shifts the underlying economic issue.  NAR spoke with both the Trump and Biden Administrations to express our issues with the moratorium and the problems it is causing for the stability of the rental housing market, on top of our advocacy in the House and Senate.
